Muscat : An accused was fined OMR 23,000 and imprisoned for a month for violating Consumer Protection law in the Wilayat of Barka , South Al Batinah Governorate.
The Court of First Instance in the Wilayat of Barka recently issued judicial rulings against a commercial establishment for violating the Consumer Protection Law promulgated by Royal Decree No. (66/2014 ) with two misdemeanors of failure to provide the service properly and in accordance with its nature and within the agreed period, failure to adhere to transparency and credibility, and the promotion of false and misleading advertisements . It ruled that the representative of the institution be punished with one month imprisonment for each case and fines of OMR 23 thousand .
The Consumer Protection Department in Barka received repeated complaints against a commercial establishment operating in the sector of selling building materials after they contracted with the establishment to purchase building materials and sanitary ware, but the establishment did not commit to delivering the commodity to the consumer on the agreed date.
Accordingly, the administration proceeded to take the necessary measures and refer the case file to the Public Prosecution Department in Barka, which in turn proceeded to complete the legal procedures and referred them to the competent court, which convicted the accused “the representative of the institution according to the text of Article (23) of the Consumer Protection Law which stipulates that: (The provider is obligated to provide the service to the consumer in the right manner and in accordance with its nature, and he is also obligated to guarantee what he provides of the service within a period of time commensurate with its nature. In the event of his failure to do so, he is obligated to refund the value of that service or in return for what makes up the shortfall or to perform it once other properly) and issued its aforementioned ruling.
The imposition of such penalties and fines comes to deter anyone who tempts himself to violate the rights of consumers and harm their health and safety and preserve all their rights guaranteed to them in accordance with the provisions of the law for the sake of a society free from negative phenomena that have an impact on individuals and society.
